ROME, 23 November 2012 - The first World Notaries Fall University, co-organized by the International Union of Notaries (UINL) together with the International Development Law Organization (IDLO) was hosted in IDLO’s headquarters in Rome.

Bringing together over 50 participants from 17 countries, students of Notarial Law, Notary candidates and young Notaries came together to share best notarial practices. The curriculum focused on topics key to the notarial profession, including, the notaries role in the evolution of land tenure, family law and corporate law, ethics, the fight against corruption and the organization of a notarial office.

As the only intergovernmental organization with the sole mandate of upholding the rule of law, IDLO recognizes the critical role notaries play in promoting good governance, the rule of law and transparency.

Divulgación de derechos de población en condición de vulnerabilidad en América Latina

SAN JOSE, 25 de octubre del 2012 – El programa EUROsociAL II, y la Organización Internacional del Derecho para el Desarrollo, IDLO en calidad de socio operativo, organizaron un Taller Regional de Necesidades y Prioridades para la Divulgación de Derechos de Población en Condición de Vulnerabilidad en San José, Costa Rica.

Contando con la participación de representantes de Ministerios de Justicia y Poder Judicial de Argentina, Brasil, Chile, Costa Rica, Honduras y Perú se identificaron prioridades nacionales y regionales para la divulgación de derechos de población en condición de vulnerabilidad, compartieron buenas prácticas y experiencias positivas, identificaron casos piloto y discutireron estrategias sobre fortalecimiento para la divulgación de derechos.

Esta es la primera etapa en un proceso de asistencia técnica que IDLO, en calidad de socio operativo de EUROsociAL II, hará en América Latina para consolidar las políticas públicas y el fortalecimiento instucional para el acceso al derecho que promueva la cohesión social.



Promoting rights of vulnerable populations in Latin America

SAN JOSE, 25 October 2012 - The EUROsociAL II program and the International Development Law (IDLO) as operating partner, organized a Regional Workshop on Needs and Priorities for the Promotion of Rights of Vulnerable Populations in San Jose, Costa Rica .

Representatives from the Ministries of Justice and the Judiciary of Argentina, Brazil, Chile, Costa Rica, Honduras and Peru participated in the workshop. Participants identified national and regional priorities for promoting rights of vulnerable populations, shared best practices and success stories , identified pilot cases and discussed strategies to strengthen the dissemination of rights.

This is the first stage of a process where IDLO, as operating partner of EUROsociAL II, will provide technical assistance in Latin America to consolidate public policies and strengthen institutions for access to rights to promote social cohesion.

IDLO hosted a Legal Experts Workshop on Trade Law for the Low-Carbon Economy: New Means to Promote Trade in Climate-Friendly Goods and Services after the United Nations Framework Convention on Climate Change (UNFCCC) 17th Conference of Parties (COP17) in Cambridge, UK on Feb 07, 2012.

Recent studies have found that sustainable trade policies can be used to foster sustainable development practices, removing trade barriers set on sustainable goods while creating new employment. In the context of fascinating debates during the UNFCCC COP 17, and important new WTO cases, these issues have become more pressing. This workshop, co-hosted by the Lauterpacht Centre for International Law (LCIL), the International Centre for Trade and Sustainable Development (ICTSD) and the Centre for International Sustainable Development Law (CISDL), considered the intersections of trade law and law on climate change, and how new treaty instruments can promote trade in climate-friendly goods and services.

Expert panelists included Marie-Claire Cordonier Segger, Head of Economic Growth and Trade at IDLO, Ricardo Meléndez-Ortiz, Director and co-founder of the International Centre for Trade and Sustainable Development and Dr. Joanna Gomula who works in the field of WTO law at the LCIL in Cambridge.

IDLO contributes to Deliberations of UNCSD (RIO+20)

On 1 November 2011, the International Law for Sustainable Development (ILSD) Partnership led by the International Development Law Organization (IDLO) released their contribution to the United Nations Conference for Sustainable Development (UNCSD, also known as Rio+20) deliberations. This input to the UNCSD compilation document was the result of a wide consultation process and discussions between the ILSD partners, which included a seminar held in Rome at IDLO in June 2011.

 

The aim of this note is to provide guidance to UNCSD Member States and other stakeholders, as well as responding to the invitation from the Second Preparatory Committee of the UNCSD, to provide input and written contributions to a document being prepared by the UNCSD.  The above request was transmitted by the Co-Chairs of the UNCSD Bureau.

 

As per their mandate and discussions, the ILSD partnership focused on the role of international law in advancing sustainable development. The goal of the ILSD Partnership is to strengthen sustainable development governance at the international, regional and national levels, laying the foundation for policy implementation by facilitating access to, compliance with, and enforcement of coherent, integrated economic, social and environmental law.

Press Conference Announces Judicial Sector’s Commitment to IDLO’s program in Kyrgyzstan

Bishkek, Kyrgyz Republic - On 27 October, IDLO together with representatives from the Supreme Court, the Judicial Council and USAID held a press conference to announce the launch of the Judicial Strengthening Program in Kyrgyzstan as well as judicial commitment to sector-wide reforms. This press conference on the much debated topic of judicial reform was extremely timely as the presidential elections were held two days later. Judicial reform is a heatedly debated subject in the aftermath of the April 2010 revolution and this press conference, attended by more than 100 people, gave a welcome platform for discussion between the judiciary and civil society. Among the important issues addressed in relation to the Judicial Strengthening Program in Kyrgyzstan were key topics such as judicial selection, transparency and independence.

IDLO Trains New Judges in the Kyrgyz Republic

Bishkek, Kyrgyz Republic - On October 14, after a five month intensive classroom and on-site training course, 36 judicial candidates, out of a total of 287 applicants, were awarded their diplomas for successfully completing the IDLO Judicial Training Program. The Acting Chair of the Supreme Court of the Kyrgyz Republic, Feruza Djamasheva, who awarded the diplomas commented that the “judicial system is an essential part of the reforms being carried out in the country. In this respect, the possibility to provide qualified personnel for the judicial system is a big achievement and I am therefore deeply grateful to IDLO for this productive cooperation as well as technical and financial assistance.”

South Sudan Ministry of Justice and State Representatives Agree on Model State Constitution

Juba, South Sudan- On 11 October 2011, the Ministry of Justice of the Republic of South Sudan (RoSS) and representatives of the country’s ten constituent states reached an agreement on a Model State Transitional Constitution, which will serve as a foundation for the transitional constitutions of the various states. In a four-day workshop organized by the Ministry of Justice with support from the International Development Law Organization (IDLO), senior Ministers, members of the National and State Judiciaries, Ministerial delegations from the states and representatives of international organizations met to develop consensus on a Model State Constitution that can be adapted to the needs of each state. The resulting Model State Transitional Constitution will contribute to national harmony by ensuring consistency between forthcoming state constitutions and the Transitional Constitution of the Republic of South Sudan (TCSS).

IDLO’s first E-learning course on “Legal Preparedness for Climate Change”

The overall objective of the e-learning course is to enable self-paced training on legal preparedness for climate change. The course aims at enhancing the capacity of legal experts, public sector energy and environment officer, and other managers of climate-related institutions, to implement adaptation to climate change, nationally appropriate mitigation of green house gases, and access to climate finance. Goal of the course is also to recommend actions on how to strengthen sustainable development law, policy and practice on climate change (regulations, management system and procedures) in their countries.

Large numbers of families have been displaced, school girls threatened, teachers kidnapped, schools burned and women’s healthcare centers destroyed. Gender-based violence in Afghanistan is not limited to one area, as the dozens of Kabul area cases and multiple studies illustrate. The Ministry of Women’s Affairs primary date base of violence against women cases, recorded 1940 cases registered in 26 (out of 34) provinces from October 2006 to Mid 2009.

IDLO is pleased to announce the appointment of Roelof H. Haveman as Field Program Manager of its program 'Strengthening the Rule of Law in Southern Sudan.'Juba Team 2010
Mr. Haveman, a Dutch national, worked since early 2008 until May 2010 as the Vice Rector in charge of Academic Affairs and Research of the ILPD/Institute of Legal Practice and Development in Rwanda. He lived and worked in Rwanda since 2005, initially for the Dutch Center for International Legal Cooperation (CILC), supporting the law faculties of the Université Nationale du Rwanda (UNR, Butare) and the Université Libre de Kigali (ULK, Kigali) in strengthening their academic and managerial capacity and quality. In addition, in 2007-2008 Mr. Haveman provided technical assistance in organisational reform for the Law Development Centre in Uganda, IDLO's current partner in judicial training in southern Sudan. Since its establishment in 2002 and until 2005, Roelof Haveman was the programme-director of the Grotius Centre for International Legal Studies at Leiden University’s Campus in The Hague. Until the summer of 2005 he held the post of associate professor of (international) criminal law and criminal procedure at Leiden University and fellow of the E.M. Meijers Institute of Legal Studies of the Faculty of Law, Leiden University, the Netherlands. Over the past 20 years he published many articles and a number of books on gender-related crimes, trafficking in persons and prostitution, customary – adat – criminal law and the gacaca in Rwanda.

Concurrently, IDLO bids farewell to outgoing Field Program Manager for southern Sudan. Ms. Lynn Sferrazza. Ms. Sferrazza has led IDLO's work in Juba since August 2009 including conducting a judicial training needs assessment, implementing a ten-week training course for judges in civil and criminal procedure and evidence and the development of a second year of programming which includes further judicial training, the development of legal resources for the judiciary and the establishment of a Legal Training Institute with financial support from the Government of the Netherlands, the European Union and UNDP. Ms. Sferrazza leaves IDLO in the highest esteem of her colleagues, counterparts and beneficiaries and IDLO wishes her the best of luck with her future endeavours.

IDLO Completes Successful Inception Mission in Haiti

IDLO has completed a successful inception mission in Haiti to determine the immediate legal needs of vulnerable groups affected by the earthquake of January 12, 2010. Despite significant challenges, IDLO was able to meet with a number of Haitian government and institutional leaders, as well as humanitarian relief actors working under the umbrella of the United Nations Office for the Coordination of Humanitarian Assistance (OCHA). IDLO received enthusiastic support from those it met, and its preliminary findings on the post-disaster legal needs in Haiti have already been endorsed by the United Nations Stabilization Mission in Haiti (MINUSTAH).

Disaster Brings Greater Risk of Child Trafficking, and Need for Protection

With disasters bringing an increased risk of trafficking in children, the International Development Law Organization warns that legal standards preventing the problem must be followed. Trafficking is a global issue affecting large numbers of children. Some estimates have as many as 1.2 million children being trafficked every year. Child trafficking is known to be one of the most lucrative and fast growing transnational crimes, and reckoned to be generating up to $10 billion annually.

IDLO Launches Judicial Training Program in Southern Sudan

IDLO has launched its first training program for judges in Southern Sudan, funded by the Dutch government. The training objectives are based on an assessment jointly conducted by IDLO and the Supreme Court of Southern Sudan in September-October 2009. Justice Reform’s New Frontier: Engaging with Customary Systems to Legally Empower the Poor

This paper adopts the position that access to justice is the foundation of legal empowerment. Activities seeking to legally empower the poor to enable them to access 'better' justice accordingly should focus on the forums impoverished populations most often use. For most of the poor in many societies, those forums are customary justice systems. The effective, efficient and just functioning of such systems has the potential to greatly contribute to the legal empowerment of low-income communities and groups. Therefore, outside organizations' engagement with customary justice systems should both promote their positive aspects and address their shortcomings.

IDLO Continues its Assistance to Aceh (Indonesia) High Court and States Courts

IDLO is delivering a three-week training for Registrars and Bailiffs from the Aceh High Court and Aceh States Court (Indonesia) from Tuesday, 28 July through Thursday, 13 August 2009.

This course is part of the Justice Education and Training Programme for Formal Justice Providers in Aceh Province (JET Programme) which comprises:

• Training for Judges in Aceh on the Supreme Court of Indonesia’s Code of Conduct and Wealth Declaration;
• Training for Judges in Aceh on anti-corruption;
• Training for Registrars and Bailiffs in Aceh on their duties and responsibilities;
• Computerization of the Case Management System of the Aceh High Court and Aceh States Courts and associated training.

The JET Programme is funded by the European Union under its Aceh Justice Project (AJP) and managed by the United Nations Development Programme (UNDP).  IDLO is implementing the JET Programme on behalf of UNDP.

Supporting the Supreme Court of Indonesia’s Blueprint for Reform, the objective of the JET Programme is to strengthen the institutional capacity (skills, systems and infrastructure) of the High Court and State Courts in Aceh to provide access to justice, uphold the rule of law, protect human rights, and promote an integrated justice system.

Last Microfinance Workshop Reaches Arab States

IDLO Microfinance program has reached the last of the scheduled twelve regional Microfinance Seminars worldwide. This Seminar is taking place in Amman, from June 7 to 18, 2009, and it aims at building legal and regulatory frameworks which support financial inclusion and poverty alleviation in the Arab States' Region.

Participants include 29 legal professionals (6 women, 23 men) working in the microfinance sector in eleven countries of the region. Both local and international microfinance experts will be presenting throughout the two week period.

The specific topics selected for the Arab States regional seminar are: transactions & negotiations related to accessing capital, transforming a NGO to a licensed MFI, consumer protection, the legal/regulatory frameworks, Shari'a & microfinance, interpreting financial ratios of a MFI & rolling out new products like mobile banking & micro insurance, agricultural finance and international investments in the microfinance sphere, and utilizing technology for community building and dissemination of information in the microfinance and development contexts.

Another important goal of this seminar is to form an enduring regional community of legal professionals, law & policy makers, financial regulators and microfinance practitioners.

Provincial Legal Training course for Ministry of Justice, Afghanistan

On May 12, IDLO started its fifth Provincial Legal Training course for 20 participants from the Ministry of Justice, Hoquq department coming from fifteen different districts of Herat Province. This two-week course takes place at the Correction Center in Herat Province.
 
The training is delivered by the national experts Mr. Mohammad Nasim Barna, General Director of Hoquq Department and Mr. Najibuallah Khosbin, Deputy of the Head of Central Hoququ Department. The course covers the following topics: Family Law and Access to Justice.
 
The opening ceremony was attended by Mr. Sayed Mohammad Rahmani, Head of Justice Department in Herat Province, Mr. Najibuallah Khoshbin, Deputy of Central Hoquq Department on behalf of the Ministry of Justice, Mr. Abdul Latif Khobaie, Representative of Independent Administrative Commission in Herat Province, Mr. Abdul Majeed, Head of Hoquq Department in Herat Province and Mr. Abdul Hamid Darwesh, Head of Training Unit in IDLO.

Independent National Legal Training Centre Board of Directors' Study Tour to Egypt

The Arab Regional office of IDLO in Cairo, Egypt hosted a one week study tour program from April 25 to 30, for the Board of Directors of The Independent National Legal Training Center (INLTC).

The purpose of the study tour was to observe a national legal training center comparable to the INLTC. The Directors had the opportunity to discuss strategy together with administrative, financial and management issues. This journey additionally explored the possible roles for the Board of Directors in the continued development of the institution in the management of the centers as well as to create a formal relationship with legal training centers and other related authorities in Egypt.

On Monday April 27, IDLO started a new E-Learning course on “Public Procurement: Policy, Strategy & Reform” (April 27 to May 24, 2009).

The course aims to enable self-paced training on public procurement:

  • to enhance the capacity of legal experts, public sector procurement offices and purchasing agency managers to implement a speedy, transparent and fair acquisition of goods and services through competitive means and
  • to recommend actions on how to strengthen the public procurement system (regulations, management and procedures).

Effective Mediation Training, Afghanistan

Kabul, April 7 2009

On April 7, IDLO launched a two-week comprehensive training on ”Conducting an Effective Mediation” for 20 selected representatives of Provincial Rights Department from the Afghan Ministry of Justice. This course aims at enhancing awareness on the importance of mediation and enabling participants to conduct effective mediation conferences as a means to decrease number of cases in front of the courts, to reduce the delay and to eliminate caseload backlog.

The opening Ceremony was attended by Mr. Hosam Helal, IDLO Technical Coordinator in Kabul, Mr. Muhammad Nasim Barna, General Head of Rights Department of Ministry of Justice, Mr.Wadir Safi, Executive Director of Independant National Law Training Center, Mr.Hamed Darwish, Head of IDLO Kabul Training of Trainers Unit and Mr. Slaven Lekic, IDLO Ministry of Justice and Parliament Component Manager.

During the first week, Mr.Slaven Lekic will introduce to the participants the following concepts:

  • mediation, arbitration and its historical background
  • comparative legislation on mediation and arbitration
  • mediation and arbitration in Afghanistan’s positive legislation

The second week will give the opportunity to Mr. Slaven Lekic to work with participants on the mediation techniques, skills and methods and more particularly on:

On April 6, IDLO opened a two-week training course on Anti-Money Laundering Law in Afghanistan for 20 Afghan prosecutors.

The opening ceremony was attended by Mr. Pir Jalaluddin Mohammad, Director of Planning and External Relations from the Attorney General Office, Dr. Wadir Safi, Executive Director of the Independent National Law Training Centre and Hameed Darwash, Head of IDLO Training of Trainers Unit.

Judge Zafar Gondal is part of the training team which will train, amongst others, the Director of the Directorate of Business Crime De Afghanistan Bank and his Advisor for three days on the current situation of this crime in Afghanistan, its region and their experience in detection and reporting of these crimes.

In 2010, William T. Loris will reach the end of his second term as IDLO's Director-General. Under the rules of the Organization, the Director-General is eligible to serve a maximum of two terms. The Assembly of Parties of IDLO has begun the search for his successor, with applications due by June 1, 2009. The election of the new Director-General will take place at the Annual Meeting of the Assembly of Parties in November of 2009.

Basic legal course continues in Herat, Afghanistan

In March 17, IDLO successfully launched its fourth Provincial basic legal course for Ministry of Justice "Hoquq and State cases department" for 27 participants.

The course takes place in Herat, Capitol of Herat Province for 4 weeks and a half. The opening Ceremony was attended by Mr. Seyed Mohammad Amin Arif Head of State cases Department, on behalf of Ministry of Justice, Head of Appeal Court Herat Province Mr.Aqiq, Deputy of Herat Governor Office Mr.Hajimir, Mr. Sayed Ghulam Mohammad Rahmani,Head of Justice Department, Mr.Haji Abdul Salam, Head of Administration Reform Commision, Mr. Mowlawi Nik Mohammad, Head of Parliamentarian Complaint Hearing Department and Mr. Slaven Lekic IDLO MoJ and Parliament component manager.

Participants represent Right (Hoqooq) and State Cases Departments of provinces of Herat, Nemroz, Farah and Badghes.

Through these training, participants learn how to analyze and understand human rights conventions, identify and understand articles of Cairo Declaration and child rights convention, better understand contracts in civil law and property law, Commercial and civil procedure law.
They acquire knowledge on commercial efficiency, business transaction and customary transaction, how to create reconciliation in state cases as a main and important step in resolving the disputes and the characteristics of arbitration and its effectiveness in order to decrease the number of cases in front of court.

On March 1, 2009, IDLO launched a two-week comprehensive training courses on “Conducting an Effective Mediation”. The course is addressed to twenty selected representatives of the Provincial Rights Department of the Ministry of Justice, with the aim of enhancing the participants’ capacity to conduct effective mediation conferences as a means to decrease the number of cases brought in front of the Courts; and to reduce the delay and eliminate the caseload backlog.

IDLO conducts a course on Inheritance Law in Kabul from the 22 February to the 5 March 2009, addressed to twenty judges from the Supreme Court.

The objective of this new training course is to increase the knowledge and skills of afghan judges on various aspects of this very complex law: from the history, definition, elements and conditions of inheritance to the entitlement of inheritance, the rights of heirs and modalities to inherit, to other related issues such as funeral, debts, and will.

The instructor of this course is Justice Abdul Azez Azez, former Dean of the Shari’a Faculty of the Kabul University.

IDLO TRAINS REPRESENTATIVES OF BOTH HOUSES ON
LEGISLATIVE DRAFTING

As a follow up of the recent Cairo Study Tour for a small numbers of representatives of both Houses of National Parliament and Legislative Department of Ministry of Justice, IDLO launched a five-day seminar for 90 representatives from the above-mentioned institutions. The objective of this comprehensive five-day “Legislation drafting” Seminar is to increase the participants’ knowledge of Legislation drafting techniques and methods and to create conditions for their active participation in on job training.

The Seminar, which will be followed by a sixth day of ‘On Job Training’ in the participants’ institutions, is taking place in the Parliamentarian Institute and participants are trained by the Egyptian expert, Dr. Mahmud Sabra.

Main objectives of this Training are:

  • To strengthen the capacity of the Legislative Department of the Ministry of Justice and Parliament to handle legislative drafting;
  • To enable trainees to become familiar with drafting techniques and practices;
  • Help trainees effectively assess and scrutinize the content of bills;
  • Help trainees understand the bill creation process, the structure of bills and basic techniques of legislative drafting;
  • Empower trainees with legislative drafting skills so that they can better appreciate their role as legislators;
  • Support the legislative process by the more effective drafting of legislation ;
  • Understand why legislation is structured in the way it is;
  • Quickly read and understand the effect of legislation;
  • Be more aware of the constitutionality of proposed legislation

IDLO launched a new Basic Legal training in the Kundoz Province of Afghanistan

On January 4 2009, IDLO opened a new course in the Appeal court’s Judicial training Center in Kundoz City, in the North of Afghanistan.

The city is the only way connecting the Takhar and Badakhshan provinces and it used to be a stronghold of the Taliban during their regime. IDLO has already conducted two training courses in Mazar, this program is therefore meant to fully cover the northern part of the country.

The program aims at enhancing the state case and rights (Hokok) staff’s knowledge and at increasing the quality of their performances. Five sessions are scheduled in the 21 days training course, from Human Rights to Real property, Commercial Law, Civil and Commercial procedures, Property Dealer and State Case Law.

The course is addressed to 30 participants from the Kundoz, Takhar, Badakhshan and Baghlan provinces. All trainers of this course are Afghans and two of them are former participants to IDLO programs in 2007.

The impact of climate change will affect the world as a whole, but its most vulnerable victims will be the poorest in developing countries. This two-week course will analyze the climate-related multilateral agreements and build a practical understanding of the rules and tools designed to promote climate change mitigation and adaptation in developing countries.  Participants will be decision-makers, policy advisors, legal practitioners, business managers and civil society representatives from developing, transition and post conflict countries who are involved in climate change-related law, policy and projects.  Visiting Experts will share knowledge on such important topics as carbon markets and trading and the clean development mechanism (CDM). Formation de Formateurs N’Djamena, Tchad 21 juillet – 1er aout 2008 Dans un contexte post conflictuel, l’Etat Tchadien s’est engagé vers l’instauration d’un Etat de droit condition sine qua non d’un environnement juridique et judiciaire sécurisé. Ce processus passe par l’érection d’une justice moderne, forte, indépendante et crédible. Pour ce faire l’amélioration de la qualité des ressources humaines évoluant dans la sphère judiciaire, notamment les magistrats et les greffiers est primordiale. Elle passe nécessairement par la réorganisation de l’Ecole encore chargée de la formation de ces derniers vers une autonomisation de l’institution et l’adaptation du programme aux besoins de performance des acteurs judiciaires. La « Réorganisation de l’ENAM » constitue l’un des axes majeurs du programme de réforme de la justice, entrepris par le gouvernement de la République du Tchad, pour la sécurisation juridique et judiciaire des activités économiques et sociales. La formation des formateurs, a concerné 30 magistrats de carrière et greffiers, ainsi que le responsable de la formation appelés à former les futurs magistrats et greffiers. La formation a eu lieu à N’Djamena pendant deux semaines et a été articulée autour d’une logique d’intervention centrée sur deux axes : - Une approche théorique sur l’ingénierie de la formation judiciaire - Des ateliers de conception de programme, permettant d’évaluer les résultats par l’élaboration d’un rapport final fixant le syllabus de la formation initiale et de la formation continue des magistrats et des greffiers. BANDA ACEH, Indonesia – IDLO and UNICEF work on improving the legal protection of children left without parental care after the 2004 tsunami

Approximately 2,800 children in Banda Aceh were left orphaned and vulnerable following the tsunami. More than 1,300 of these has since been reunited with their primary caregivers. IDLO has trained guardians, caregivers and village leaders to protect the legal rights of such children in the community.
